(Scope of application)
Article 1
Transportation contracts related to the cableway business operated by our company will be conducted in accordance with the provisions of these terms and conditions. Matters not stipulated in these Terms and Conditions shall be governed by laws and regulations, and when not stipulated by laws and regulations, general customs shall apply.
(Staff instructions)
Article 2
Our staff (hereinafter referred to as "Staff") will give instructions to passengers when necessary for safe transportation and maintenance of order, but please be sure to follow these instructions.
(Acceptance of transportation)
Article 3
The Company will accept passenger transportation unless the Company refuses to accept the transportation pursuant to the provisions of Article 4.
(Refusal of acceptance of transportation)
Article 4
Our company will refuse to accept passenger transportation in the following cases.
(1) When you do not have a valid ticket.
(2) When you do not follow the instructions of the staff.
(3) When the passenger requests a special burden regarding the transportation concerned.
(4) When the transportation concerned is contrary to the provisions of laws and regulations, public order, or good morals.
(5) When it is deemed difficult to ensure transportation safety due to the passenger's condition, etc.
(6) When you are in possession of dangerous goods, etc.
(7) When there are transportation problems due to natural disasters or other unavoidable reasons.
(8) In addition to the cases listed in the preceding items, when there is a justifiable reason.
(Sales of tickets, etc.)
Article 5
The Company sells tickets, etc. at ticket booths, etc.
(Validity of tickets, etc.)
Article 6
1 Tickets, etc. are valid only when used under the conditions written on the ticket.
2 If we change the fare or charge, tickets issued before the change will remain valid until the expiry date, regardless of the fare amount displayed on the ticket.
3 If you use anything other than a valid ticket, etc. at our company, it will be invalidated.
4 Tickets, etc. will be invalidated if any of the following apply.
(1) When used without complying with the conditions written on the face of the ticket.
(2) When a season ticket is used by someone other than the holder of the season ticket.
(3) When used in a modified, altered or forged manner.
(4) When the information on the ticket is difficult to read.
5 Tickets are valid and can only be used by the customer who purchased them. It is prohibited to gift or sell it to another person, in which case it will be returned as invalid.
(Presentation of tickets, etc.)
Article 7
When passengers board the train, we will ask them to present their tickets, and depending on the type of ticket, we will check it, insert it, or collect it.
(Fare, Charges and Application Method)
Article 8
The fares, fees, and application method that the Company collects from passengers are based on the separate fare table and the application method specified separately.
(Handling of passengers en route in case of suspension of operation)
Article 9
For passengers in the event that cableway operation is suspended due to natural disasters or other unavoidable reasons, necessary measures will be taken to ensure continued transportation, such as issuing valid tickets free of charge once operation resumes.
(Freight Refund)
Article 10
If the cableway cannot be operated due to natural disasters or our company's responsibility, refunds will be made according to separately stipulated regulations. However, this does not apply if the vehicle is temporarily suspended due to wind, snow, etc. that may pose a danger to driving.
(Start and End of Responsibility)
Article 11
The Company's responsibility for transportation begins when the passenger performs the act set forth in Article 7 and ends when the passenger disembarks the vehicle.
(Passenger prohibited acts)
Article 12
Passengers must not do the following:
(1) Jumping off the carrier or getting on and off the vehicle at a location other than the designated location.
(2) Shaking skis or carriers.
(3) Hitting the cableway facilities with skis, poles, etc.
(4) Riding in a dangerous position, such as riding sideways.
(5) Doing any other act that impedes safe transportation.
(Responsibility regarding passengers)
Article 13
If our company injures the life or body of a passenger through the operation of the cableway, we will be responsible for compensating for the damage caused. However, this does not apply in the following cases.
(1) When it is proven that the Company has not neglected to pay attention to the provisions of laws and regulations regarding the operation of the cableway, and that the cableway facilities have no defects or malfunctions.
(2) When it is proven that the accident occurred solely due to the passenger's intention or negligence.
(Liability regarding personal effects, etc.)
Article 14
The Company shall not be liable for any damage caused by loss or damage to skis or other personal belongings arising from the transportation of passengers. However, this does not apply if the loss or damage is due to our negligence.
(Passenger Responsibility)
Article 15
If our company suffers damage due to a passenger's intentional or negligent behavior or failure to comply with laws and regulations or the provisions of these Terms of Carriage, we will seek compensation for the damage from the passenger.
(Additional fares, etc.)
Article 16
If a ticket held by a passenger is invalidated pursuant to the provisions of Article 6, Paragraphs 3 and 4, the Company will charge the passenger an amount equivalent to the ticket, etc., and a premium fare, etc. within the same amount.
Supplementary provisions
These terms and conditions will come into effect from April 1, 2020.
